Media Accreditation Terms & Conditions
These Terms govern the issue, use, and revocation of musick.com.au media accreditation credentials. They apply to all photographers who register with the musick photographer platform and receive a musick contributor ID. Please read them carefully before applying.
1. About Musick Media Accreditation
musick.com.au ("musick", "we", "us") is an Australian live music platform operated by Brendan Faulds (ABN 48 752 572 088), 22 Billabong Rd, Goolwa South SA 5214.
Musick media accreditation is a credential issued to approved photographers to support coverage of live music events in Australia. It is a statement by musick that we recognise the photographer as a contributor to our platform and that we have verified their identity and agreed professional standards with them.
Accreditation does not constitute employment by musick. Accredited photographers are independent contributors, not employees, contractors, or agents of musick.
2. What Accreditation Grants
- A musick contributor ID (e.g. MSK-PHOTO-XXXXXX) and an official accreditation letter that may be presented to venues, promoters, and artists.
- The ability to represent yourself as an accredited photographer for musick.com.au when seeking media access to live music events.
- A profile on the musick.com.au photographer directory.
- The ability to upload and publish photography to the musick.com.au platform.
3. What Accreditation Does Not Grant
- Guaranteed access. Musick accreditation is an intent-to-cover credential only. Venues, promoters, artists, and their representatives retain absolute discretion to grant or deny access to any individual, regardless of their accreditation status. Musick cannot compel access on your behalf.
- Blanket access to all events. Each event must be approached on its own terms. Some events require separate accreditation from the promoter or artist management, independent of musick's credential.
- Employment rights or entitlements. You are not an employee of musick. You are not entitled to payment, superannuation, leave, insurance, or any other employment benefit from musick.
- Exclusive coverage rights. Musick does not guarantee you exclusivity at any event. Other media may be present.
4. Eligibility
To be eligible for musick media accreditation, you must:
- Be aged 18 or over.
- Be a resident of Australia.
- Be an active photographer with genuine experience or serious intent to document live music events.
- Have agreed to the musick Photographer Code of Conduct and these Terms.
- Have an active musick.com.au account.
musick reserves the right to decline an application for any reason, and to verify the information provided during registration.
5. Duration and Renewal
- Accreditation is granted for a period of twelve (12) months from the date of approval.
- Accreditation may be renewed at the end of each period, subject to ongoing compliance with the Code of Conduct and these Terms.
- Musick will notify you before your accreditation expires. It is your responsibility to apply for renewal in a timely manner. Lapsed accreditation does not confer any rights to continued access.
- Renewal may be refused if you have been in breach of the Code of Conduct or these Terms, or if your activity on the platform has been insufficient to justify renewal.
6. Non-Transferability
Your musick accreditation and contributor ID are issued to you personally. They are strictly non-transferable. You must not allow any other person to use your accreditation letter, contributor ID, or any other musick credential. Doing so is grounds for immediate revocation.
7. Your Obligations
- Carry your current accreditation letter to events where you intend to use it. Digital copies on your phone are acceptable.
- Present your accreditation and government-issued photo ID when requested by venue staff, security, or event management.
- Comply with the musick Photographer Code of Conduct at all times.
- Keep your contact details and profile information on musick.com.au current.
- Upload a reasonable volume of photography to the platform. Accreditation is contingent on genuine contribution. Photographers who hold accreditation but never publish content may not be renewed.
- Notify musick promptly if your accreditation letter is lost, stolen, or compromised.
8. Musick's Rights
- Suspension. Musick may suspend your accreditation while investigating an alleged breach of the Code of Conduct or these Terms.
- Revocation. Musick may revoke your accreditation at any time for breach of the Code of Conduct, these Terms, the general Terms and Conditions of musick.com.au, or any other conduct that musick reasonably considers harmful to the platform, its reputation, or third parties.
- Record-keeping. Musick will record the reason for any suspension or revocation. This record is retained indefinitely and may be considered in the event of a future re-application.
- No compensation. Musick is not liable to pay any compensation in connection with a suspension or revocation, regardless of the circumstances.
9. Indemnity
You indemnify musick.com.au, its operators, directors, and staff against any claim, loss, damage, cost, or liability arising from:
- Your conduct at any event you attend in an accredited capacity;
- Any content you publish on musick.com.au or elsewhere in connection with your accreditation;
- Any breach of these Terms or the Code of Conduct;
- Any claim by a third party arising from your photography or your use of the musick credential.
10. Image Rights and Licensing
You retain copyright in all photographs you take. By uploading images to musick.com.au:
- You grant musick a non-exclusive, royalty-free, worldwide licence to display, reproduce, and promote those images in connection with the musick platform, including for editorial coverage, platform marketing, and social media.
- You confirm that you hold the rights to publish each image and that doing so does not infringe any third party's rights.
- You may withdraw the licence for specific images by removing them from the platform.
11. Privacy
The information you provide during registration (including your name, contact details, professional background, and IP address at time of agreement) is collected and stored by musick.com.au in accordance with our Privacy Policy. Your agreement records — including which version of each document you accepted and when — are retained as part of our governance obligations.
12. Governing Law
These Terms are governed by the laws of South Australia, Australia. Any dispute arising under these Terms is subject to the exclusive jurisdiction of the courts of South Australia.
13. Changes to These Terms
Musick may update these Terms from time to time. We will notify accredited photographers of material changes by email. Continued use of your accreditation following such notice constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you must notify musick and your accreditation will be lapsed.
